Introduction
The eFlow Customer Agreement Terms and Conditions have now been renamed the eFlow (Registered Customer) Account Terms and Conditions.
The eFlow (Registered Customer) Account Terms and Conditions (along with the Account Application Form) sets out the agreement between customers and Transport Infrastructure Ireland (“TII”) in relation to the opening and operation of registered customer Accounts with eFlow. An account may be a Video Tolling Account or a Tag Tolling Account.
In the case of a Tag Tolling Account, the terms and conditions also deal with the issue of your Tag as well as your responsibility for correctly mounting the Tag in your Vehicle.
Purpose of this Document
The purpose of this news post is to set out a summary of the main amendments which TII has made to the eFlow (Registered Customer) Account Terms and Conditions. For full details, please see the latest eFlow (Registered Customer) Account Terms and Conditions which are available on the eFlow website.
The meaning of the capitalised terms used in this summary document are set out in the eFlow (Registered Customer) Account Terms and Conditions.
Clause 19 of the eFlow (Registered Customer) Account Terms and Conditions allows TII to amend the terms and conditions. The amendments come into force and are effective on the earlier of (i) 14 days after notification of the changes to you; or (ii) when you have a toll transaction on the M50 Toll Road.
Main Amendments
- General – We have made some clarificatory amendments to the eFlow (Registered Customer) Account Terms and Conditions which are designed to make the terms and conditions clearer and to remove any provisions which are no longer relevant. We have also made amendments which are designed to give customers more options (e.g. allowing you to move unpaid M50 Toll Road charges onto your Account).
- Section A (Notification of Amendments) – We have amended the second paragraph in section A to allow amendments to reflect the new name of the M50 Toll Pay App, now the eFlow: My Tolls app.
- Section B (Opening an Account) – We have included new provisions in section B.1 which clarify the information which is to be included in the Account Application Form, in particular confirmation as to whether new Customers wish to apply unpaid M50 Toll Road charges to their Account (in which case they pay those unpaid tolls at the cheaper registered customer rate), as well as other relevant information that may be requested by eFlow in connection with the opening of an Account (see also 4 and 5 below).
- Section B (Applying unpaid M50 Toll Road charges to your Account) - We have included new provisions in paragraphs 5 and 6 of Section B which outline an option for Customers to apply existing unpaid M50 Toll Road charges to their Account where those charges relate to the Vehicle(s) which the Customer is registering and were incurred before such registration. The new provisions also explain that where these unpaid charges are applied to a Customer Account, they will be paid using the particular Payment Method which is registered to the Account.
- The new provisions also note a risk that, when applying unpaid charges relating to a Vehicle to an Account, these unpaid charges may relate instead to the previous owner of the Vehicle if the Vehicle has been purchased recently. This is on the basis that it can take up to 30 days for the NVDF to be updated to reflect the change in ownership of a vehicle. The new provisions further clarify that a Customer must contact eFlow as soon as possible once they become aware that unpaid charges have been applied to their Account that do not relate to them.
- Finally, the new provisions also note that a Customer remains liable for unpaid M50 Toll Road charges at the rate of charges and fees which apply to Unregistered Vehicles in circumstances where they choose not to apply the unpaid charges to their account.
- Tolls (Clause 4.1) – We have included wording in Clause 4.1 to make clear that you will be liable to pay any unpaid M50 Toll Road charges and/ or penalty Fees relevant to the Vehicle(s) registered to your account and incurred when the Vehicle was not registered to your Account in circumstances where you have chosen to apply those charges and/ or penalty Fees to your Account.
- Removal of Low Emissions Vehicle Toll Incentive Tag Tolling Clause (Clause 6) – The provisions regarding the Low Emissions Vehicle Toll Incentive Scheme have been removed as the Scheme is no longer available.
- Payment of Tolls and Charges – Rejected Payments (Clause 6) – We have inserted wording in Clause 6.2 to clarify the risk that, unless outstanding amounts have been paid (together with any charges arising from a Rejected Payment), a Customer may be subject to an Account Suspension 14 days after a Rejected Payment.
- Pre-Pay Account (Clause 7) – We have inserted wording in Clause 7a to clarify that the current Account Start-up Balance for a Prepay Account of forty euro (€40.00) for each Registered Account may be varied from time to time.
- Cancellation of Agreement (Clause 16.3) - We have inserted wording in Clause 16.3 to make it clear that, in the case of Video Tolling, Customers will not be entitled to exercise the right to cancel the Agreement if within the fourteen (14) day cancellation period if they make a journey on the M50 Toll Road such that the Toll the Customer is liable to pay is the Toll applicable to the holder of an Account.
- Data Protection (Clause 20) - We have amended Clause 20 to reflect the updated names for the eFlow Privacy and Cookies Statement, which is now referred to as the eFlow Website Privacy Notice and Cookies Policy.
- Notices (Clause 28) – We have amended clause 28 to allow notices under the eFlow (Registered Customer) Account Terms and Conditions to be sent by any of the following means: posting, email, SMS, telephone, web chat or by push notification on the eFlow: My Tolls app.
